CMC Neptune Data Privacy Policy 2024

  1. Data Ownership: CMC Neptune LLC recognizes that the ownership of all personally identifiable information (PII) pertaining to students, teachers, administrators, and parents belongs to the clients it serves.
  2. CMC Neptune LLC is responsible for safeguarding personal information. The company only uses data from its clients for educational services and does not engage in the sale or marketing of such data.
  3. Type of Data Maintained for CMC Neptune LLC: We collect and maintain personal information needed for accessing Voyager (for Neptune GameTime, Neptune Radio, and Neptune SchoolZone) and for the proper function of the Neptune Navigate platform, and to enable services including single sign-on and rostering for our partners.
    1. The majority of the data is considered Directory Information such as name, title, and email address. CMC Neptune LLC also collects the following data for our Navigate education partners specifically: Student/employee local ID numbers, building assignment, grade level, homeroom, class name and period, and teacher name.
    2. CMC Neptune LLC does not retain personal demographic data, including mailing address, gender, and date of birth.
  4. CMC Neptune LLC takes great care to maintain the confidentiality and security of all personal data. The company ensures data security through a range of measures, including internal data management policies and procedures, restricted access to personal data, encryption of data in transit and at rest, constant data systems monitoring, incident response plans, and protective measures to prevent unauthorized access during data transmission over communication networks. If necessary, CMC Neptune LLC may disclose personal data to public authorities in accordance with lawful requests.
  5. CMC Neptune LLC permanently deletes personal data upon termination of a contract, or when it is no longer necessary, or when the customer explicitly requests it.
  6. CMC Neptune LLC provides an option for users or authorized administrators to review and correct any personal information stored on the platform

In the event of a security breach resulting in the unauthorized disclosure of personal data, CMC Neptune LLC will immediately inform the affected customers, conduct a thorough investigation, and take necessary measures to restore the integrity of its data systems promptly. CMC Neptune LLC will also fully cooperate and provide assistance in issuing required notices to individuals affected by the breach.
  8. To safeguard the interests of its customers, CMC Neptune LLC will uphold business insurance policies.
  9. CMC Neptune LLC commitments to to student privacy are as follows:
    1. We will not collect, store, utilize, or disclose any personal information of students beyond what is required for permissible educational or school-related purposes, unless explicitly authorized by the parent or student.
    2. We will not sell student personal information.
    3. We prohibit the use or disclosure of any student information collected through an educational/school service, whether it is personal information or not, for behavioral targeting of advertisements directed towards students.
    4. We do not create a personal profile of a student, except when necessary for supporting authorized educational/school purposes or with explicit authorization from the parent or student.
    5. We do not make any substantial changes to our privacy policy without first providing advanced notice to our partners, which may include the educational
      institution/agency. We allow them choices before data is utilized in any manner inconsistent with the initial terms provided. We also ensure that there are no substantial changes made to other policies or practices governing the use of student personal information that are inconsistent with contractual requirements.
    6. We do not keep any student personal information beyond the required time period needed to support authorized educational/school purposes or with explicit authorization from the parent or student.
    7. We collect, utilize, distribute, and retain student personal information solely for purposes that have been authorized by the educational institution/agency, teacher, or the parent/student.
    8. We clearly state in contracts or privacy policies, in a manner that is easy for parents to comprehend, the types of student personal information, if any, that we collect. Additionally, we never maintain or share information with third party vendors
      1. Our approved software developer has access to the CMC Neptune LLC
        platform, and is held to the same security standards and requirements as
        CMC Neptune LLC per this privacy policy.
    9. We provide support for the access to and correction of student personally identifiable information by the student or their authorized administrator. We offer this support either by assisting the educational institution in meeting its requirements or directly when the information is collected directly from the student with student/parent consent.
    10. We maintain a comprehensive security program that is reasonably developed to safeguard the security, privacy, confidentiality, and integrity of student personal information against risks such as unauthorized access or use, or unintended or inappropriate disclosure. We accomplish this by utilizing administrative, technological, and physical safeguards that are appropriate to the sensitivity of the information.
    11. We mandate that our vendors who receive student personal information to deliver educational services, if any, are obligated to implement the same commitments for the given student’s personal information.
    12. In the event of our merger or acquisition by another entity, we would only allow the successor entity to maintain the student personal information if the successor entity agrees to abide by the same commitments for the previously collected student personal information.
